An Action Relating to Health, Education and Human Services; Amending the Navajo Nation Personnel Policies Manual to Exempt Navajo Head Start Program Employees from Section IV(K)
Legislation Description
This resolution, if approved, will amend the Navajo Nation Personnel Policies Manual (NNPM) to include the Navajo Nation Head Start Program Employees, amongst commissioned law enforcement personnel and employees of the Navajo Nation Gaming Regulatory Office, as being exempt from Section IV (K) of the Navajo Nation Gaming Regulatory Office, as being exempt from Section IV(K) of the Manuel. This amendment does not exempt the Navajo Head Start Program from either federal, state or tribal background checks as they are required to perform those in accordance with federal law. However, this amendment would allow the Navajo Head Start Program to Hire employees on a conditional basis while their federal/state background checks are being competed. Those federal/state background check services are provided through a contract with a private company. The tribal background check service will continue to be through Navajo Public Safety - Information Management Section. The NNPM states that the policies contained therein should be amended by the Health, Education and Human Service Committee at the recommendation of the Division of Human Resources. The Director of the Division of Human Resources has expressed that he does not recommend these changes as the Division has concerns about how stringent the federal standards required by the Head Start Act are in comparison to the standards required by the Navajo Nation.
